Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before enrolling in From the Gut Up (the "Program"), offered by Kody Shipe, BCHHP with Living Well Functional Health, LLC and Robin Flores, BCHHP with Wellness In Thyme, LLC ("we," "us," "our"). By purchasing, accessing, or participating in the Program, you ("you," "member," "participant") agree to be bound by these Terms. If you do not agree, do not enroll.

1. Program Description

From the Gut Up is a 16-week educational program that includes a GI-Map stool test, a 1:1 video interpretation of your results, individualized protocol recommendations, foundational supplements, a 14-day liver detox and 2–4 month gut detox protocol, weekly live group calls, educational content, and community support, as described on the sales page at the time of your purchase.

2. Not Medical Advice

This Program is educational and informational in nature. It is not medical care, and it does not create a doctor-patient relationship. The information, recommendations, and protocols provided through the Program — including any interpretation of your GI-Map results, dietary guidance, supplement recommendations, or detox protocols — are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice, diagnosis, or treatment.

You should consult your physician or other qualified healthcare provider before starting this Program, especially if you are pregnant or nursing, have a pre-existing medical condition, take prescription medication, or are otherwise under the care of a medical provider. Never disregard professional medical advice or delay seeking it because of anything you learn through this Program.

Our practitioners are Board Certified Functional Practitioners. They are not licensed Registered Dietitians, Naturopathic Doctors, or Medical Physicians, nor are they licensed to diagnose or treat medical conditions.

3. Eligibility & Health Disclosures

The Program is not appropriate for everyone. By enrolling, you confirm that you have disclosed any known medical conditions, allergies, pregnancy or nursing status, and medications to us prior to beginning any elimination diet, detox protocol, or supplement regimen, and that you have received clearance from your healthcare provider to participate if you have any condition that could make participation unsafe.

You assume full responsibility for consulting your own healthcare provider regarding whether the Program, including its elimination diet, detox protocols, and supplement recommendations, is appropriate for your individual circumstances.

4. Supplements

Any supplements recommended or provided as part of the Program have not been evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease. You are responsible for reviewing supplement labels and ingredients and for disclosing any allergies, sensitivities, or medications that could interact with recommended supplements to your practitioner before use.

5. Enrollment, Payment & Payment Plans

Enrollment is confirmed upon receipt of payment in full, or, for members selecting the payment plan, upon receipt of the deposit and initial payment of $697. The second and third payments of $400 will be automatically charged 30 days and 60 days after enrollment using the payment method provided at signup. It is your responsibility to ensure your payment method remains valid and sufficiently funded; failure to remit payment as scheduled may result in suspension of Program access until payment is resolved.

Enrollment closes August 14, 2026. The Program begins August 25, 2026. Kody Shipe, BCHHP with Living Well Functional Health, LLC reserves the right to close enrollment earlier if capacity is reached, and to adjust program dates with reasonable notice to enrolled members.

6. Refund Policy

There are no refunds on any fees paid or services provided. In the case you choose not to follow through with the Program or withdraw at any date or time, any remaining balance or past unpaid invoices are expected to be paid in full and payment plans will continue until the Program has been paid in full.

7. Results Disclaimer

Individual results vary. Testimonials, examples, and any statements about outcomes reflect the experiences of specific individuals and are not a guarantee, promise, or representation that you will achieve the same or similar results. Your results depend on factors outside our control, including your individual health history, adherence to the protocol, and biological response.

8. Assumption of Risk & Limitation of Liability

Participation in the Program, including any dietary changes, elimination protocol, detox protocol, or supplement use, is undertaken at your own risk. To the fullest extent permitted by law, Living Well Functional Health, LLC, Wellness In Thyme, LLC, its owners, practitioners, employees, and affiliates shall not be liable for any injury, loss, or damage — direct, indirect, incidental, or consequential — arising from or related to your participation in the Program.

9. Group Calls, Community & Conduct

Weekly group calls and the private community space are provided for education, accountability, and peer support. Members agree to treat other participants and practitioners with respect. Kody Shipe, BCHHP with Living Well Functional Health, LLC reserves the right to remove any member from the community or Program, without refund, for conduct it determines in its sole discretion to be abusive, harassing, or disruptive.

Content shared by other members or practitioners in group calls or the community space is not individualized medical advice and should not be treated as such.

10. Confidentiality & Privacy

Your GI-Map results, health information, and any information shared during your 1:1 consultation are kept confidential. Information you choose to share in group calls or the community space is visible to other participants and is shared at your own discretion.

11. Intellectual Property

All curriculum content, videos, handouts, protocols, and materials provided through the Program are the property of Living Well Functional Health, LLC and Wellness In Thyme, LLC and are licensed to you for personal, non-commercial use only. You may not copy, distribute, resell, or share Program materials outside of your own personal use without our prior written consent.

12. Program Access & Technical Requirements

Curriculum access begins August 15, 2026. Prior to that date, enrolled members may have access to the community space but not to curriculum content. You are responsible for ensuring you have the internet access and device compatibility needed to participate in live calls and access online materials. Recordings of live calls will be made available in the member portal for those unable to attend live, for the duration specified at the time of purchase.

13. Changes to the Program or These Terms

We may update these Terms from time to time. Material changes will be communicated to enrolled members. Continued participation in the Program after such changes constitutes acceptance of the updated Terms. We may also make reasonable adjustments to Program content, scheduling, or format as needed to maintain the quality of the Program.

14. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions.
